Priority court established in Durban to fast-track immigration cases

The Department of Home Affairs, in partnership with the Department of Justice and Constitutional Development, has established a priority court in Durban to fast-track immigration matters.

This follows a verification process which found that nearly 2 000  Malawian nationals were living in the country illegally.

The priority court will operate virtually under the authority of the Durban Magistrate’s Court as government intensifies efforts to process deportation orders and enforce immigration legislation.

Department of Home Affairs spokesperson and Deputy Director-General for Operations, Thulani Mavuso, explains “1 876 Malawian nationals have been confirmed to be residing in the Republic in contravention of South Africa’s immigration laws. The verified contraventions include visa overstays, expired travel documents and undocumented status, all of which constitute grounds for deportation in terms of our immigration act. The priority court will operate through a virtual platform at Sherwood Park under the authority of the Durban Magistrate’s Court to facilitate the consideration and confirmation of deportations in respect of the affected individuals. The government of Malawi has facilitated the return of 676 of its nationals.”
